Is the FTC the next ATF?

In terms of determining when a gun becomes a gun or showing up at gun owner’s homes to ask them about their recent purchases, no. But in terms of being a federal alphabet agency weaponized by the gun control lobby to target the firearms industry, it’s a distinct possibility.

The latest chapter of the gun control movement’s attempt to make gun manufacturers their new bogeyman (after decades of the NRA playing that role) comes from the pages of USA Today, where reporters Nick Penzenstadler and Amritpal Kaur Sandhu-Longoria have published a lengthy piece on the complaints made by anti-gun groups to the Federal Trade Commission claiming the firearms industry’s advertising is false (for advocating the self-defense benefits of gun ownership) and in some cases even advocates for the criminal misuse of their products.

Democrats and advocates seeking to address gun violence argue that owning a gun does not make your home safer, a case for false advertising, and that marketing offensive “tactical operations” with military-grade weapons constitutes unlawful use of the product.
Just as Joe Camel and the Marlboro Man became flashpoints for a crackdown on cigarette ads in the 1990s, a handful of images are dominating the national debate. Among them is a series of ads from Remington about a “combat” AR-style rifle for “the infinite number of extreme scenarios you’ll face in the worlds of law enforcement or personal defense.”

Seeing an opening, gun control advocates have filed a series of complaints and petitions with the Federal Trade Commission, the independent agency charged with protecting consumers from unfair or deceptive marketing.

The messages use fear to suggest everyone needs a firearm to defend themselves and their property, according to David Pucino, deputy chief counsel at Giffords, the gun control group founded by former Rep. Gabby Giffords. Pucino maintains that is a lie.

As I said on today’s Cam & Co, one of the things driving this new push to target gun ads is the fact that gun sales soared over the past couple of years. The last thing the gun control lobby wants are millions of new gun owners, even though I doubt that many of them ever even saw a gun ad before they decided to purchase a firearm during the Great Gun Run of 2020/2021. That’s not the only reason, however. This effort has been underway for quite some time. In fact, you could make the case that this has been an ongoing strategy of the gun control lobby since the 1990s.

When Beretta began advertising in Ladies Home Journal in the early 1990s, gun violence researchers started to take notice of the shift.

The spots featured an unsecured, loaded pistol on a bedside table and instructed consumers to “tip the odds in your favor” and to think of a gun as “homeowner’s insurance.” They led the Center to Prevent Handgun Violence — the precursor to Brady — to file its first petition with the FTC in February 1996.

Joined by children’s health groups and pediatricians, the gun control group argued that ads suggesting you’re safer with a gun were unfair and misleading.

The Federal Trade Commission declined to act on the complaint by the CPHV back then, but that doesn’t mean the agency won’t take action now, especially with a Democrat-majority among FTC commissioners. The National Shooting Sports Foundation has written a letter of its own to the agency imploring them to be “drawn into ideological crusades by deep-pocketed special interests.”

That would the wise move, but who knows if the FTC will take it. It’s probably true that advertising trends have shifted from a focus on hunting and shooting sports to self-defense or tactical use over the decades, but that doesn’t mean that there’s anything improper or untoward about that. The Supreme Court itself has said that the fundamental purpose of the Second Amendment is self-defense, so why would it be misleading in any way for a gun company to promote its products as a tool to protect you and your loved ones? Surely these companies have a First Amendment right to encourage the exercise of our Second Amendment rights?

[David] Yamane, the Wake Forest professor, writes and speaks about liberal gun owners, including himself. He said that although it makes sense for the FTC to get involved in regulating firearm ads, the bar for proving misleading advertisements is high.

“There’s the issue of if on average gun ownership makes people less safe, that average would include tens of thousands for whom guns made them safer,” Yamane said. “I wonder how this would apply to other forms of security advertising. I’m bombarded by ads for security systems and cameras claiming they make you safer. Should the FTC regulate that?”

The case for the affirmative is even weaker today than it was in the 1990s. Back then the gun control lobby didn’t have to contend with the Heller, McDonald, and Bruen decisions that have repeatedly affirmed the right to both keep and carry a firearm for self-defense. While the anti-gun groups have chosen to ignore the implications of those decisions on their demands, the Federal Trade Commission cannot overlook what the Constitution and the highest court in the land says about the right to armed self-defense.

Everytown files Federal Trade Commission complaint against Daniel Defense

When you’ve got your own in-house law firm funded by your billionaire backer, its easy to waste time and effort on unserious efforts, which helps explain Everytown’s new complaint against Georgia gunmaker Daniel Defense accusing it of “deceptively marketing” firearms to teenagers through its advertising and brand placement in video games and movies. More fundamentally, however, the gun control group’s filing with the Federal Trade Commission is part of a broader strategy aimed at shutting down gun companies, and the complaint against Daniel Defense is only the latest in a string of similar filings against members of the firearms industry in recent months

We’ll get to those prior complaints in a few paragraphs, but first let’s delve into Everytown’s ridiculous assertions.

Daniel Defense has leaned on social media, especially Instagram, which has a young user-base, to promote its weapons, the complaint says, and the company does not restrict access to its accounts to users who are old enough to buy its products.

In one Instagram post, for example, the company featured a picture of Post Malone holding one of its rifles with the caption: “MK18 got me feeling like a rockstar.”

Another post, from the same day as the Uvalde shooting, promoted the DDM4 V7 model rifle — the same one the gunman would later use — with the hashtag “loadout,” a term for the gear a soldier carries into battle that the complaint says is a reference to “Call of Duty,” a game the shooter reportedly played. The company also often uses hashtags such as #callofduty and #cod to make its “Call of Duty” references on social media, the complaint says.

That’s it? Post Malone and Call of Duty?

I’m a soon-to-be 48-year old who listens to Post Malone (ironically after my wife, who’s nine years my senior, turned me on to his music) and played Call of Duty and other first-person shooters for years until fairly recently, and I’m far from alone. In fact, according to data on Call of Duty demographics, only about 1/4 of all players are younger than 25, which makes sense given the game’s “M” rating. Everytown has absolutely no evidence that Daniel Defense is intentionally marketing its firearms to younger teenagers, which frankly would be a terrible business strategy given that you can’t even purchase a rifle until you’re 18-years old. And if Daniel Defense is marketing its products to adults under the age of 21 there shouldn’t be an actionable issue since that age group is able to lawfully purchase and possess a long gun under federal law.

This complaint has less to do with Daniel Defense specifically and much more to do with the gun control lobby’s attack on the firearms industry as a whole.

Everytown has filed multiple complaints in recent years against Smith & Wesson, alleging the company uses deceptive practices to market its rifles to young, male consumers in a similar way. Smith & Wesson rifles were used by gunmen in Parkland in 2018 and Aurora, Colo., in 2012. The man accused of killing seven people in Highland Park on July 4 allegedly used a Smith & Wesson rifle, as well.

“The FTC has effectively given the gun industry a free pass,” advocacy groups wrote earlier this year as they petitioned the agency to investigate the industry’s marketing.

The groups, including Brady, the Giffords Law Center, March for Our Lives and the Firearms Accountability Counsel Taskforce, argued inaction has “allowed the gun industry to spend decades using unfair and deceptive advertising to sell deadly weapons to an American public that has been falsely led to believe that gun ownership is a safe way to protect their home and family.”

The complaint against Daniel Defense says the industry at large has sought to appeal to young buyers.

It cites efforts by The National Shooting Sports Foundation, an industry group, to promote shooting sports as “cool” activities for young people, and quotes materials from the group saying: “Although peer pressure and influence are often thought of in a negative context, such influence can often mean a positive effect on youth.”

That’s right. The gun control lobby wants gun makers fined for promoting the use of firearms in self-defense; a right explicitly protected by the Constitution. And the supposedly “reasonable” activists who swear up and down that they aren’t opposed to the Second Amendment even take issue with the NSSF and other groups promoting trap, skeet, and other competitive shooting outlets that have become quite popular in recent years. The first round of the Minnesota High School trap shooting championships recently featured nearly 8,000 teen trap shooters from all across the state; a number that Everytown and their ilk would like to reduce to zero.

The good news is that none of these prior complaints appear to have gone anywhere, and based on the weak sauce Everytown presents as evidence in its complaint against Daniel Defense my guess is that the same will be true here as well. The broader attack on the firearms industry, however, isn’t going to stop anytime soon, and the gun control lobby won’t be satisfied until they’ve made it impossible or illegal to own a firearm… not to mention buying, selling, making, or marketing one.
