AB5’s Chickens Coming Home to Roost? OOIDA Truckers Fight Secy of Labor Nominee Julie Su

As RedState reported on Wednesday, California Congressman Kevin Kiley did a joint press conference with Assembly Republicans, business organizations, and independent professionals affected by AB5 to oppose President Joe Biden’s nomination of Julie Su for U.S. Secretary of Labor. While not a part of Congressman Kiley’s press conference, on March 3, the Owner-Operator Independent Drivers Association (OOIDA) submitted a letter to the Senate Committee on Health, Education, Labor & Pensions (HELP) asking them to reject Su’s nomination. Su’s implementation of AB5 did, and continues to do, tremendous harm to the trucking industry in the state of California. No one wants to see this same damage spread nationwide, and OOIDA is trying to cut it off at the pass.

Truckers and their mode of operations represent a last bastion of independent entrepreneurship in our country. Our food supply and other commerce chains depend upon the work that they do. But Big Labor only sees dollar signs and flagging membership. While certain segments of trucking are unionized, the owner-operator model of motor carriers has resisted this, because you make a whole lot more money, have a greater degree of flexibility, and can negotiate higher pay rates if you are your own boss. In my own interviews with California truckers for a piece I did for another outlet, many of these owner-operators are multigenerational, passed on from parents to children, and their families have been in California for decades. The life is akin to ranchers, farmers, and other agricultural businesses in the state. The ownership investment and independence are the main draws. It’s just that simple. It is government that has made it complicated.

What AB5 did in California is destroy this model. Despite numerous court challenges to exempt themselves from this ridiculous and work-killing law, in June 2022, the U.S. Supreme Court declined to review the California truckers’ last challenge, so they became subject to the restrictions imposed by the law. The result? Some truckers have left the industry, and others are moving their operations out of the state.

Just as Congressman Kiley has been doing in his speeches, letters, and advocacy, OOIDA CEO Todd Spencer’s letter to the HELP Committee points out the failure, malfeasance, and outright destructiveness that ensued when Julie Su, as California’s Labor and Workforce Development Secretary, implemented and enforced AB5. OOIDA is vowing, never again.

The Owner-Operator Independent Drivers Association represents 150,000 owner-operators leased to motor carriers, small-business motor carriers with their own operating authority, and employee truck drivers. We oppose Ms. Julie Su’s nomination to lead the Department of Labor and the Senate Committee on Health, Education, Labor, & Pensions must reject her nomination in order to protect the livelihoods and careers of the hard-working truckers we represent. Her record as California Labor Commissioner and Secretary for the California Labor and Workforce Development Agency, including her support for AB5 and overseeing its disastrous implementation, demonstrates she would pursue policies that threaten our members’ ability to use a business model they have properly and beneficially used for decades.

Spencer further said of AB5,

This is the most disruptive worker classification policy to be enacted anywhere at the state or federal level.

And all California independent professionals, freelancers, and self-employed say, “Can I get an Amen?!” Spencer pulls no punches on his disdain for Su’s lack of knowledge and lack of competence.

When asked about AB5 in an interview, Ms. Su responded that it was meant to address misclassification that has “resulted in the day labor-ization of our economy.” She continued, “Instead of the steady, consistent, reliable work, people end up basically in odd jobs and you’re hustling all the time, right? So AB 5 is meant to address that kind of misclassification so that we can bring more people who should be under the protection of our labor laws back on that floor.”

These comments demonstrate either an ignorance of the owner-operator model in trucking or an overly broad generalization of how different workers operate as independent contractors. For the tens of thousands of truckers who have enjoyed a successful career as an owner-operator, it would come as a surprise to learn that their business represents an “odd job” in need of fixing.

This has been the argument among independent professionals since before this law passed or had even been implemented. In its so-called push to help misclassified “workers,” AB5 employs a broad brush approach that swept in those of us who are independent by choice, are hustling because we like the hustle, and who did not need government intervention to negotiate what we wish to be paid and how we are paid. California lawmakers did not care that in its greedy efforts to control truckers and rideshare drivers, it was destroying an entire independent contractor model that not only facilitates the engines of the economy but, in many ways, drives it.

Make no mistake: Independent contractors have comprised a good portion of the 500,000 people who have done the California Adios over the past two years. This not only represents a loss of population, but a loss of business revenue, corporate taxes, and all the ancillary businesses that revolve around it. California Secretary of Workforce Su instituted this madness for the state. A Secretary of Labor Su would further spread this chaos nationwide, and OOIDA’s Spencer wants to let Senate Chairman Bernie Sanders and Ranking Member Bill Cassidy know that Su’s nomination should not be allowed to stand.

It has been frustrating enough for small-business truckers that the California legislature ignored their concerns when enacting AB5. But the implementation of the law has been just as, if not more, disappointing. For months after the law was enacted, OOIDA sought guidance about how the law would apply in the trucking industry and how small businesses and independent contractors could potentially comply. Despite our efforts, we were left with essentially no guidance before the law took effect. The law and its haphazard rollout has forced independent contractor truckers to leave the state of California, become an employee, attempt to reconfigure their business, operate under a cloud of uncertainty, or abandon the trucking profession altogether.

For these reasons, we are concerned that Ms. Su would continue to pursue an ideologically-motivated agenda towards worker classification that ignores the thousands of small-business truckers that depend on the ability to work as an independent contractor. Make no mistake, if Ms. Su were to advance the same policies that she championed in California, it would force hundreds of thousands of truckers to change their business model and put their livelihood in jeopardy.

Spencer points out that despite offering to help California and national lawmakers understand how the independent contractor model works for the trucking industry, there continues to be a push to enact one-size-fits-all solutions that only erode and undermine a model that works not just for one industry, but for independent contractors and professionals across the United States. However, he concludes by extending the olive branch of goodwill once again, while warning that a confirmation of Julie Su would only hamper—not help—any forward progress.

We stand ready to work with Senators to address misclassification and improve working conditions in the trucking industry. But we believe that Ms. Su’s confirmation would make it extremely difficult to fix these issues in a way that benefits America’s truckers.

Or America’s independent professionals, freelancers, and self-employed. Julie Su’s nomination should and must be opposed.

Presser With Kevin Kiley and CA Assembly Republicans to Stop Julie Su’s Labor Secy Nom: ‘Stop Rewarding Failure’

Congressman Kevin Kiley (R-CA 06) organized a press conference on Wednesday, joining with California Assembly Republicans in their opposition to the nomination of Julie Su for the role of U.S. Secretary of Labor. President Joe Biden nominated Su to fill the shoes of departed Labor Secretary Marty Walsh.

RedState has reported what a disaster this would be here, here, and here. Congressman Kiley was joined by Assembly Republican Leader James Gallagher, business leaders, and freelancers affected by California’s AB5 law. Members of the California Assembly: Josh Hoover (AD-07), Joe Patterson (AD-05), Jim Patterson (AD-08), and Bill Essayli (AD-63) also joined Kiley and Gallagher on the steps of the State Capitol in Sacramento. Since this nomination was announced, many other organizations have rallied behind Congressman Kiley to oppose Su’s nomination, including the California Business and Industrial Alliance (CABIA), the Owner-Operator Independent Drivers Association (OOIDA), and the International Franchise Association (IFA).

Congressman Kiley opened up the press conference, and drew a bright line between the passage of California’s disastrous AB5, and the 32 billion in unemployment insurance fraud to Julie Su’s tenure as California’s Labor Secretary. Su’s hackery and incompetence affected millions of California residents and small business owners. Kiley declared Su:

Manifestly unqualified to be the next Secretary of Labor to the United States.

CABIA’s President and Founder Tom Manzo talked about Su’s hand in putting small businesses and entrepreneurs under the thumb of draconian labor laws—11,000 pages worth—and the cudgel of “wage theft” that has been imposed on many small businesses because of a simple error of a late lunch or an address discrepancy. Manzo also outlined Su’s enthusiastic championing and enforcement of AB5 and PAGA.

Manzo reminded all that CABIA was one of the first California organizations to oppose Su’s nomination for Deputy Labor Secretary. Sadly, this fell on deaf ears. Tom Indrieri of the Lincoln Area Chamber of Commerce was also present, opposing the nomination. The smaller, more business-dependent community of Lincoln, California stands in sharp contrast to the Los Angeles Chamber of Commerce, which slathered all over itself in a letter of support for Su’s nomination.

Band Leader and Musician Aaron Gayden spoke for the five million freelancers, independent contractors, and self-employed whose livelihoods and businesses were decimated by AB5. Gayden warned that if Su is promoted to Secretary of Labor, she will push through the PRO Act and shepherd through the changes to the Independent Contractor Rule and the Election Protection Rule.

Gayden declared,

“The nation cannot stand having Julie Su as the Secretary of Labor.”

Asms. Josh Hoover, Jim Patterson, Joe Patterson, and Bill Essayli stood behind Kiley and Gallagher to show their support. Asm. Essayli had some harsh truths to share about the importance of competency, and how Biden’s nominees and appointees do not seem to measure up to that standard.

Case in point: Secretary of Transportation Pete Buttigieg, a poster child of incompetent leadership.

“He may be a talented politician, but he is an awful Transportation Department Secretary,” Essayli said.

“We are now seeing the results of incompetence at the top. Near misses at the airport, the first shutdown of U.S. airspace since 911, and the series of train derailments poisoning our communities and shaking rail passengers confidence in our system.

“Here in California we have firsthand experience with incompetence: We had Julie Su.

“Julie Su was asleep at the wheel, and struggling Californians paid the price.”

And should she be confirmed by the Senate, the entire nation will also pay that price. Essayli expressed his own shock that Su managed to fail upward, and is now so close to this executive-level cabinet position.

“I’m frankly shocked that she’s even being considered. I’m frankly shocked that she is even employed. She should be fired, and someone else be considered.”

Amen to that.

Congressman Kiley wrapped up the presser by pointing out that the California Way is not a model the nation should be following. Blind partisanship and governance for the sake of special interests, rather than the constituents and taxpayers only produces disaster and frankly, costs lives. The recent weather-related disasters in San Bernardino County, California and Governor Gavin Newsom’s failed response cost 13 people their lives, and there may be more to come. Just as Newsom’s horrible record of governance should disqualify him for higher office, so it should be for Julie Su. If she is allowed to take the reins of the U.S. Department of Labor, her horrible record of management in California will become a national reality.

CABIA Comes Out Swinging Against Secretary of Labor Nominee Julie Su

The California Business and Industrial Alliance (CABIA) is once again taking the gloves off. Through resources to small business, information and advocacy campaigns, CABIA was instrumental in cutting the California Private Attorney General’s Act (PAGA), which targeted small business owners with nonsense lawsuits, off at the knees. The organization went on high alert with President Joe Biden’s announcement nominating Deputy Labor Secretary Julie Su to ascend to Secretary of Labor Secretary. On Wednesday, CABIA wrote a letter to the Chair of the House Subcommittee on Workforce Protections, California Congressman Kevin Kiley, expressing solidarity with Kiley’s efforts to see this nomination stopped.

Today, the California Business and Industrial Alliance (CABIA) joined Rep. Kiley, members of the Subcommittee on Workforce Protections, members of the California Congressional Delegation, and countless freelancers in opposition to Julie Su for Secretary of Labor. Opposition to Su’s nomination has continued to mount as her track record of mismanagement and targeting freelancers in California has come to light.

CABIA’s letter to Kiley brings the receipts as only those who have firsthand knowledge of Su’s handiwork could bring. President and Founder Tom Manzo wrote, in part:

Californians, including thousands of your constituents and small business owners, have borne the brunt of Su’s misguided leadership. Prior to serving as the U.S. Deputy Secretary of Labor, Su served as the California Labor Secretary and headed California’s Division of Labor Standards Enforcement.

As the top labor official in California, Su oversaw a massive failure of California’s unemployment insurance (UI) system. The Employment Development Department (EDD), a department Su oversaw that handles UI claims, struggled to keep up with claims as Californians lost their jobs at the beginning of the pandemic. Tens of thousands of Californians struggled to stay afloat as the backlog of unpaid claims continued to grow.

The disaster triggered an emergency audit of the EDD which found rampant fraud throughout the system. While hard-working Californians waited in an endless unemployment backlog, criminals, including death row inmates, raked in money from the state. As much as $1 billion in fraudulent payments was distributed to inmates, including convicted murderer Scott Peterson. Sen. Dianne Feinstein even had a fraudulent claim made in her name.

In total, Su admitted that roughly 1.4 million claims were flagged as fraudulent and up to $40 billion was wrongly distributed while she oversaw the department. Su was named in the state audit for her failed leadership.

CABIA also alleges to have intel on Su’s corrupt dealings before she became an employee of the state, and then federal government, and her mismanagement of the PAGA law.

CABIA also compiled a report recounting Su’s careless dealings in California, information on her background before joining the public sector, and documenting hundreds of millions of dollars in fraudulent payments during her time at the EDD.

Beyond fraudulent unemployment claims, Su also failed to address harmful labor laws on the books in California, including the Private Attorneys General Act (PAGA). For years, PAGA has allowed employees to file frivolous lawsuits against employers for any perceived infraction — even minor or accidental — of California’s 1,100-page Labor Law Digest. Under Su, the policy continued to be weaponized by attorneys who often made millions at the expense of the state’s small business owners.

CABIA is further upping the ante by running a television commercial in the D.C. markets, criticizing Su’s nomination. This ad will air on CNN, MSNBC, Good Morning America, and the TODAY Show.

The destruction of the engines of the American economy must stop, and the only way to staunch the bleeding and rebuild revenues is to take back the agencies intent on colluding with Labor unions and large corporations to shake down and eschew small business, entrepreneurs, and workers. Confirming Julie Su as Secretary of Labor would only be a continuation of the disastrous policies of the Biden Administration toward those ends, especially the implementation of the PRO Act. CABIA is working with Congressman Kiley and the House Subcommittee on Workforce Protections to see this nomination undone.
