New York Dems set to defy SCOTUS with new concealed carry laws

New York legislators are expected to ram through new restrictions on the right to carry in Albany today, where Gov. Kathy Hochul has called them back for an “extraordinary session” to respond to last week’s Supreme Court ruling striking down the state’s “may issue” carry permitting regime. We don’t even have the text of the proposed legislation, yet multiple media outlets are reporting that Hochul could sign the legislation today. Lawmakers aren’t going to have time to read the bill or bills being proposed, much less digest what their real world impact will be, but that’s clearly less of a concern for them than doing anything and everything they can to continue to put roadblocks between New Yorkers and their Second Amendment rights.

While we don’t know all of the specifics of the legislation, the details that have emerged in interviews with Hochul are enough to foresee another court challenge on the horizon.

Businesses that want guns around would have to put up a sign reading, “Concealed weapons welcome here,” or words to that effect, Hochul said. “Otherwise the presumption will be in the state of New York that they are not.”

“We’re going to protect the rights of private property owners allow them to not have to be subjected to someone walking into their workplace or a bar, restaurant with a concealed weapon,” Hochul said.

The state is setting new requirements for getting a handgun permit, Hochul said, including mandating 15 hours of in-person fire range training. The legislature will also enact new rules around firearm storage in homes and vehicles, she said.

Hochul and fellow Democrats also plan on creating a comprehensive list of “sensitive places” where the average citizen will be banned entirely from carrying firearms, including government buildings, hospitals, schools and public transit.

The governor says the new anti-2A measures “go right up to the line” drawn by the Supreme Court, but that’s not the case at all. Hochul and the Democrats who vote for this legislative nightmare are blatantly disregarding what the Bruen opinion had to say about “sensitive places” as well as imposing onerous requirements beyond mandating that concealed carry applicants demonstrate a “justifiable need” to carry.

… expanding the category of “sensitive places” simply to all places of public congregation that are not isolated from law enforcement defines the category of “sensitive places” far too broadly. Respondents’ argument would in effect exempt cities from the Second Amendment and would eviscerate the general right to publicly carry arms for self-defense…

As Justice Clarence Thomas made clear, while there may be a few exceptional circumstances where the lawful carrying of firearms can be banned, those are the exceptions and not the rule. Hochul’s plan would not only make every business in the state a de-facto gun-free zone, but most public spaces, according to the governor, would be off-limits to those with valid concealed carry licenses.

Federal, state, local government buildings, health and medical facilities, places where children gather, day cares, parks, zoos, playgrounds, public transportation, subways, buses, polling places, educational institutions,” Hochul said.

The governor was asked if her proposal goes beyond what the Supreme Court will allow.

“It sounds like you’re shutting off all of the public places,” a reporter said.

“I can’t shut off all places,” Hochul said.

“So what would be left?” the reporter asked.

“Probably some streets,” Hochul said.

The intention is clear: to artificially suppress the number of individuals exercising their right to publicly carry arms for self-defense in defiance of the Supreme Court and the Constitution. That goes not only for Hochul’s attempt to turn most of the state into a gun-free zone, but also the new onerous and burdensome training requirements she wants to impose on those looking to exercise their right to carry. Fifteen hours of live-fire training is going to make it nearly impossible for many New Yorkers to obtain a license, simply because they won’t be able to afford the cost of ammunition. Range availability is also going to be a huge issue, and as Thomas specifically noted in his opinion, efforts to depress the number of individuals exercising their right to carry through “lengthy wait times in processing license applications or exorbitant fees deny ordinary citizens their right to public carry” can also be subject to constitutional challenges if they are put to “abusive ends.”

We’re going to be talking with Tom King, executive director of the New York State Rifle & Pistol Association later today on Bearing Arms’ Cam & Co about Hochul’s proposals and the litigation that is sure to follow. The New York governor may think she can ignore what the Court had to say about our Second Amendment rights, but if these ideas are enshrined into law another SCOTUS smackdown is almost certainly on the way.

Here is another race that wasn’t even close. New York Republicans made their choice, and it wasn’t Andrew Guiliani.

The Associated Press projects that Rep. Lee Zeldin has won New York State’s Republican gubernatorial nomination.

Zeldin, a four-term lawmaker who represents New York’s 1st Congressional District, which covers the eastern half of Long Island, topped a field that also included Rob Astorino, the former Westchester County executive and 2014 GOP gubernatorial nominee; Andrew Giuliani, who served in former President Donald Trump’s administration and is the son of former New York City mayor and former Trump attorney Rudy Giuliani; and Harry Wilson, a businessman, investor and restructuring expert who poured millions of his own money into his gubernatorial bid.

Zeldin will now face off in November against Democratic Gov. Kathy Hochul, the state’s former lieutenant governor who was sworn in last August as New York’s first female governor, after three-term Democratic Gov. Andrew Cuomo resigned in disgrace amid multiple scandals.

Governor Kathy Hochul has turned out to be as much of a disaster as Andrew Cuomo. She is a COVID zealot who, like California Governor Gavin Newsom, holds on to emergency powers given to the governor during the COVID pandemic so that she can lord it over New Yorkers with mask mandates and vaccine restrictions. A recent poll showed that 54 percent of New Yorkers feel Hochul is doing a poor job. Zeldin has already declared that he does not support mask or vaccine mandates, and if elected governor, will lift the mandates and relinquish emergency powers.

The last Republican governor elected in New York state was George Pataki, 20 years ago. Will Zeldin be the one to tear down that wall?

LIVE ELECTION RESULTS: Colorado, Illinois, New York, Oklahoma, Utah Primaries – Plus Special Elections and Runoffs

Another Tuesday, another set of primaries. This week, it’s primaries in Colorado, Illinois, New York, Oklahoma, and Utah, with runoff elections in Mississippi and South Carolina and special elections in Nebraska, Oklahoma, and South Carolina. Here’s what to keep an eye on:

Colorado

Colorado’s US Senate primary features an uncontested Democratic race for incumbent Michael Bennet. On the Republican side, Ron Hanks and Joe O’Dea are facing off.

There are eight congressional districts for the Centennial State. For the Democrats, only the First, Third, and Fifth districts have contested races. For the Republicans, it’s incumbent Lauren Boebert in the Third District, facing a challenge from Don Coram, while incumbent Ken Buck is challenged by Robert Lewis in the Fourth. The Fifth, Seventh, and Eighth districts also have contested races.

Incumbent Democrat Governor Jared Polis is not being challenged. The Republicans competing for the spot are Greg Lopez and Heidi Ganahl.

Illinois

In Illinois, Tammy Duckworth’s Senate seat is up for election. The Democrat is not being challenged in the primary. However, on the Republican side, there are seven contenders.

17 House seats are also up — most notably, the newly (torturously) redrawn 15th District pits current Representatives Rodney Davis and Mary Miller against one another. Donald Trump has endorsed Miller.

J.B. Pritzker, the current Governor, actually has a primary challenger: Democrat Beverly Miles. The Republican primary has been hotly contested with Richard Irvin and Darren Bailey seen as the top two contenders, Bailey having earned a Trump endorsement, as well.

Mississippi

Mississippi has a Republican runoff for the Second District between Brian Flowers and Ronald Eller.

Nebraska

There’s a special election in Nebraska’s First District between Republican Mike Flood and Democrat Patty Brooks, necessitated by the resignation of Republican Congressman Jeff Fortenberry who, in March, was convicted of lying to the FBI regarding a foreign campaign contribution.

New York

In New York, there’s a gubernatorial primary — one that doesn’t feature a Cuomo! Kathy Hochul, who stepped in when Andrew Cuomo resigned last August, faces two challengers for the Democratic nomination. On the Republican side, the contenders are Rob Astorino, Andrew Giuliani, Harry Wilson, and Lee Zeldin.

Oklahoma

Oklahoma has a regular Senate primary, where Republican incumbent James Lankford has two challengers and there are multiple Democrats facing off, as well. There is also a special Republican primary for the seat vacated by James Inhofe’s pending resignation (in January of 2023). Current Representative Markwayne Mullin is expected to finish atop the heap but may face a runoff for the spot in August.

There are also four House districts with contested races for the Republicans, as well as gubernatorial primaries for both the Democrats and Republicans, though incumbent Kevin Stitt is favored to retain his seat.

South Carolina 

In South Carolina, there’s a runoff for the Democrats for Senate, between Catherine Fleming Bruce and Krystle Matthews.

Utah

Utah Senator Mike Lee faces a primary challenge for his seat from Republicans Becky Edwards and Ally Isom. That will likely be a cakewalk for him (though Independent Evan McMullin awaits in November).

Additionally, there are four House districts with contested races, including the Fourth District, where incumbent Burgess Owens faces off against Jake Hunsaker.

Blue state Dems set to impose new (and unconstitutional) carry bans

I don’t think any Second Amendment supporters believed that the Democrats in charge of the “may issue” states immediately impacted by the Supreme Court’s decision in New York State Rifle & Pistol Association v. Bruen were going to simply roll over and accept the Court’s ruling that the right to bear arms in self-defense is an individual and fundamental right, but the anti-gun left is wasting no time in defying SCOTUS by proposing a host of new restrictions aimed at minimizing the Court’s decision and curtailing the right to carry for as many citizens as possible.

In New York, Gov. Kathy Hochul is calling legislators back to Albany for an “extraordinary session” in response to the Bruen decision, and is proposing to ban the lawful carrying of firearms in a variety of locations, including virtually all private businesses; a move that’s also a part of New Jersey Gov. Phil Murphy’s plans for a concealed carry crackdown.

Ms. Hochul has suggested barring guns from schools, places of worship and events attended by a certain number of people. She has also said the state might ban guns from businesses as a default, making exceptions for those who affirm that they want guns on their property. And she said that training and storage requirements might also be on the table for those seeking permits.

Along with the sensitive places that Ms. Hochul has mentioned, New York is considering designating all places where alcohol is served (such as bars, large sporting events) and where children spend time (such as nurseries, playgrounds and day cares). Other places under consideration as “sensitive” include college campuses, hospitals and casinos.

The state may also be able to restrict the carrying of guns outside such places, according to one of the people with knowledge of the discussions, though they will have to be careful not to place large swathes of densely populated areas off limits, which would likely run afoul of the ruling.

It’s cute that Hochul’s confidants are pretending to give a dam about running afoul of the Bruen decision at the same time they’re completely ignoring what the decision had to say about efforts like this. Justice Thomas specifically warned New York about trying to make most of the state or a given city a “gun-free zone,” but that admonishment has fallen on willfully deaf ears.

Although we have no occasion to comprehensively define “sensitive places” in this case, we do think respondents err in their attempt to characterize New York’s proper-cause requirement as a “sensitive-place” law. In their view, “sensitive places” where the government may lawfully disarm law-abiding citizens include all “places where people typically congregate and where law-enforcement and other public-safety professionals are presumptively available.”

It is true that people sometimes congregate in “sensitive places,” and it is likewise true that law enforcement professionals are usually presumptively available in those locations. But expanding the category of “sensitive places” simply to all places of public congregation that are not isolated from law enforcement defines the category of “sensitive places” far too broadly. Respondents’ argument would in effect exempt cities from the Second Amendment and would eviscerate the general right to publicly carry arms for self-defense that we discuss in detail below. Put simply, there is no historical basis for New York to effectively declare the island of Manhattan a “sensitive place” simply because it is crowded and protected generally by the New York City Police Department.

As we talked about on Monday’s Cam & Co, anti-gun politicians in California are encouraging local police chiefs and county sheriffs to use the state’s “good moral character” clause to continue to deprive law-abiding citizens of their right to bear arms, while in Hawaii lawmakers are looking at “screening, training requirements and ways to keep guns out of public spaces,” according to state Sen. Chris Lee. Meanwhile, Hawaii gun owners have been lining up to apply for a license now that the “good cause” requirement has been declared unconstitutional.

Andrew Namiki Roberts and Jon Abbott, of the Hawaii Firearms Coalition, were the fourth and fifth people Thursday morning to apply for a concealed weapon permit at the Honolulu Police Department’s downtown headquarters.

Roberts says the state and counties aren’t currently issuing permits but will have to under the Supreme Court ruling.

“So we’re glad. We’re super excited,” Roberts said.

“We know that we’re going to get concealed carry permits. We know that we’re going to get open carry permits. We know that the law is going to change. Law-abiding citizens in Hawaii will be able to carry a firearm.”

Eventually that will indeed be the case, but Democrats are going to make it as difficult as possible in the meantime. That includes passing new laws that don’t have a chance of being upheld under the standard laid out in Bruen, which means that gun owners and Second Amendment activists can’t get complacent. Yes, we won a critically important case at the Supreme Court, and one that will have wide-ranging and positive implications for our right to keep and bear arms, but as the anti-gun left is demonstrating in states and cities across the country, the fight for full recognition of our Second Amendment rights is far from over.

Not in a shop, not at a bus stop! New York to go Dr. Seuss in “extraordinary” legislative session

It’s been less than a week since the momentous ruling in NYSRA v. Bruen, which overturned New York’s anti-Italian animus-driven Sullivan Law and shredded corruption-riddled “may-issue” discretionary permitting schemes from coast to coast. The anti-Rights crowd reacted hysterically to it as expected. However, the brain trust at the Gun Grab Lobby had been anticipating this for a long time, and has been hard at work in adapting to the ruling by finding other pretexts and artifices to limit the rights the people just won back.

As reported in Newsday (archived link): 

NY lawmakers nearing agreement to amend concealed-carry law

ALBANY — Gov. Kathy Hochul and legislative leaders were finalizing an agreement Monday to amend New York’s concealed-weapons permitting process — adding 15-20 hours of training, including live-fire practice, for example — when the State Legislature convenes Thursday.

Lawmakers are planning to return to the State Capitol for an “extraordinary session” to address a U.S. Supreme Court decision last week striking down the state’s century-old concealed-carry law. The court effectively said New York’s criteria for issuing permits was too subjective.

Some of the terms being discussed include “live-fire training,” which the state doesn’t mandate now for a concealed-weapon permit, a source said. Applicants also might be required to complete an in-person interview with a licensing agent.

New York, which until today, did not require privileged concealed carry permit holders (such as Donald Trump) to get 15-20 hours of training or live-fire practice, is now requiring those suddenly because the poors and the rubes and the blacks and the browns are about to exercise their constitutionally-protected rights. My state’s leaders are so alarmed by the prospect of equality and the loss of control over the people that they are convening an “extraordinary session” to ruminate and legislate new ways to infringe upon and prevent everyone from exercising their rights.

“Want a permit? Sure, meet in-person with a licensing agent. Sorry, our next available appointment is 8 months out and you will need to drive 120 miles to it.”

Everything they are going to do now is squarely aimed at raising the costs – both money and time – required to exercise our pre-existing rights that were selectively granted to the wealthy and well-connected.

In reaction, the governor and leaders of the Senate and Assembly were planning to change the law in two major ways: Adding some objective requirements, such as a minimum amount of training and a background check, and detailing a list of “sensitive areas,” such as public transit, where concealed weapons would be outlawed.

Sensitive areas might include transportation hubs, courts, schools, playgrounds, libraries, municipally owned stadiums and any place serving alcohol.

The governor indicated lawmakers want to give private businesses the authority to keep guns off their premises. Sources said businesses would have to affirmatively “opt in” to declare they are allowing guns. The default position would be for businesses to prohibit guns.

“We’re going to have sensitive places identified, where you cannot bring guns. It will not be on subways. It will not be on buses,” Hochul told reporters Monday. “We’re going to have a whole host of places restricted.”

There you have it. New York Democrats, licking their wounds, are going to create yet another patchwork of sensitive places to ensnare decent, harmless people in legal trouble. There have been a whole host of violent incidents to prove that gun-free zones, unless augmented with security screening, absolutely don’t work. And even when there’s security screening, there’s a solid chance that guns will make it through, as we have seen in repeated failed audits of the Transportation Security Administration (TSA).

The opt-in requirement for businesses is intended to force them to advertise themselves as Second Amendment-friendly businesses, thus inviting boycotts from the overabundant hoplophobes in this state.

Even though NYSRPA v. Bruen ruling sets a new judicial standard in evaluating legislative and executive infringements, we cannot underestimate the Dr. Seuss-like creativity of the anti-Rights crowd: 

Not in a shop, 

Not at a bus stop, 

Not in a bar, 

Not in your car…

Each of those infringements will entail continued battles.
