Two Gallup PD officers injured after SUV careens through New Mexico parade and crashes into police cruiser

On August 4, 2022, in Gallup, New Mexico, a tan SUV traveling at approximately 60 mph veered up the Gallup Ceremonial Parade route while the parade was in progress. The street was crowded with revelers and onlookers taking part in the Gallup Intertribal Ceremonial, a Native American heritage celebration now in its 100th year.

While the Gallup Police Department has indicated that no pedestrians were struck, New Mexico State Police noted that multiple people, including two GPD officers, were injured and treated on the scene.

According to Fox 3, the vehicle, said to be a Chevy Tahoe, smashed into a police vehicle and then careened into the front window of Red Shell Jewelry. One of the three suspects allegedly attempted to flee the scene on foot via Route 66, but was captured by police.

Gallup Police indicated that the vehicle and its three occupants have been detained. The suspects have been identified as Dave Begay, Jefferey Begay, and Davidson Begay.

In one video of the arrest, police can be seen yanking at least one suspect out of the crashed SUV.

Supreme Court approval actually goes UP after Roe overturned; partisan approval gap highest on record

American approval of the Supreme Court actually increased after the historic decision overturning Roe v. Wade.

What are the details?

Despite outrage from pro-abortion activists, overall approval of the Supreme Court has ticked up 3% compared to last year, a new Gallup survey found.

In September 2021, overall approval was 40%; this year, 43%.

The poll was conducted between July 5-26, which means the survey measured reactionary feelings related to the overturning of abortion precedents (Dobbs v. Jackson Women’s Health Organization) and the reaffirmation of the Second Amendment (New York State Rifle & Pistol Association Inc. v. Bruen).

Still, public approval for the high court has been on a downward spiral for several years.

Public approval was below 50% from September 2011 until July 2018, remaining above 50% until last July when it sunk to 49%, according to Gallup data.

However, the most significant finding from the Gallup survey is just how tribal court opinion has become: Just 13% of Democratic voters told Gallup they approve of the Supreme Court right now, while 74% of Republicans said they approve.

The 61-point partisan gap is the highest Gallup has ever recorded.

Anything else?

The survey results come after Supreme Court Justice Elena Kagan last month suggested the court should be beholden to public opinion lest it lose its legitimacy.

“I’m not talking about any particular decision or even any particular series of decisions, but if over time the court loses all connection with the public and with public sentiment, that’s a dangerous thing for a democracy,” she said, Reuters reported.

“Overall, the way the court retains its legitimacy and fosters public confidence is by acting like a court, is by doing the kinds of things that do not seem to people political or partisan,” Kagan added.

What the Gallup survey shows, however, is that American approval of the Supreme Court is based mostly on their political opinion of court rulings, not on the court’s jurisprudence. Thus, when the court rules in a way that Republicans want, they approve; and when the court rules in a way that Democrats want, they approve.

It turns out, in fact, that the next-largest partisan gap in the Gallup poll surveying Supreme Court approval came in 2015 after the Supreme Court ruling on gay marriage in Obergefell v. Hodges.

At that time, 76% of Democrats approved of the Supreme Court, while just 18% of Republicans approved. Perhaps, then, the Supreme Court should steer completely away from considerations of public confidence.

Biden's already abysmal job approval rating sinks to new low in Gallup polling

While President Joe Biden has been underwater in Gallup’s job approval polls for quite some time, he has now fallen to a new low of just 38%.

The July 5-26 survey of adults in the U.S. found that while just 38% approve of how the president is handling his role, a whopping 59% disapprove. While 13% strongly approve, 25%, moderately approve, 45% strongly disapprove, and 14% moderately disapprove.

Just 78% of Democrats and 31% of independents approve of Biden’s handling of his role. While 30% of Democrats strongly approve, 48% moderately approve, 13% moderately disapprove, and 6% strongly disapprove. And while 9% of independents strongly approve, 22% moderately approve, 20% moderately disapprove, and 43% strongly disapprove.

“Democrats were already facing a tough environment in this fall’s midterms as they seek to retain their narrow majorities in the U.S. House of Representatives and Senate. Biden’s now weaker approval makes their odds of doing so even steeper,” Gallup noted.

While Biden has said that he plans to run for re-election as long as he is healthy, he could face a difficult primary contest if public sentiment does not shift in his favor going forward.

A CNN poll found that 75% of “Democrats/Democratic-leaning independents who are registered to vote” believe that the Democratic Party should go with someone other than Biden as the 2024 presidential nominee, while only 25% felt that the party should nominate Biden.

Democratic Rep. Dean Phillips of Minnesota has said that he does not want Biden to run for re-election in 2024.

“Biden has been the principled, stabilizing bridge the country needed. I just believe it’s time for generational change in Congress and the White House,” Phillips said, according to CNN’s Manu Raju.

Biden is already the oldest president in U.S. history and would be 86 years old by the end of a second term in office.

Elena Kagan gets lesson in constitutional history after warning about court losing public approval

Supreme Court Justice Elena Kagan expressed concern Thursday over what she believes is the danger of the Supreme Court straying from public opinion.

What did Kagan say?

Speaking at a judicial conference in Montana, Kagan warned democracy is endangered when the highest court in a land loses touch with public sentiment.

“I’m not talking about any particular decision or even any particular series of decisions, but if over time the court loses all connection with the public and with public sentiment, that’s a dangerous thing for a democracy,” she said, Reuters reported.

“Overall, the way the court retains its legitimacy and fosters public confidence is by acting like a court, is by doing the kinds of things that do not seem to people political or partisan,” Kagan added.

The comments were the first time Kagan has spoken publicly since the court overturned Roe v. Wade four weeks ago.

Kagan, who was appointed to the Supreme Court by Barack Obama, stressed the high court “earns its legitimacy by what it does, by the way it behaves” and said justices must be consistent in their jurisprudence.

For what it is worth, a recent Gallup poll showed that public confidence in the Supreme Court is sinking to an all-time low.

What was the response?

Kagan’s comments drew a sharp reaction on social media. Critics highlighted that Kagan emphasized public sentiment to the detriment of the Constitution.

Constitutional law scholar Jonathan Turley, in particular, offered a pointed response in which he described Kagan’s remarks as “concerning.”

In fact, Turley explained in an essay that Kagan’s sentiment “runs against the entire purpose of the Court as, at times, a countermajoritarian institution designed to follow the Constitution rather than the polls.”

Pointing to Alexander Hamilton and Federalist Paper 78, Turley explained the Founding Fathers designed the Supreme Court “to defy public opinion.”

“It was designed defy everyone and everything other than the Constitution,” Turley wrote. “It was that countermajoritarian role that allowed the Court to end segregation and confront other prejudices in our society. It is designed to defund the smallest and most insular minority when law is on its side.

“Many jurists and law professors do not believe that the Court should consider public opinion in rendering its decisions. Federal judges are given lifetime tenure to insulate them from such pressure or considerations,” he added.

“The legitimacy of the Court depends not on being consistent with public opinions but the Constitution,” Turley declared. “This is a particularly important moment to emphasize as bounties are offered on the movements of justices and one justice was recently the target of an alleged attempted murder.”
