Manchin gives Democrats a reality check on gun control

Democratic lawmakers are calling for new gun control legislation in the wake of the racially motivated massacre in Buffalo, New York, last weekend, but once again Sen. Joe Manchin (D-W.Va.) is standing in the way of the most fervent progressives.

President Joe Biden went to Buffalo on Tuesday and visited with the families of 10 people who were killed and three others wounded by a white supremacist gunman. In a speech, the president denounced the attack as an act of “domestic terrorism,” condemned white supremacy, and renewed calls for a federal ban on so-called “assault weapons.”

“There are certain things we can do. We can keep assault weapons off our streets. We’ve done it before. I did it when I passed the crime bill,” Biden said, referring to the 1994 Violent Crime Control and Law Enforcement Act, which included a 10-year assault weapons ban.

Senate Majority Leader Chuck Schumer (D-N.Y.), also speaking in Buffalo Tuesday, vowed that Democrats would “work towards finally ridding our streets of weapons of war.”

But Manchin, speaking to reporters shortly before Biden spoke, gave his realistic assessment that in the 50-50 Senate, the only gun control legislation that has a chance of passing is a bipartisan compromise on background checks that previously failed. That bill, named for Manchin and his chief co-sponsor, Sen. Pat Toomey (R-Pa.), would expand federal background check requirements to all advertised commercial sales, including sales at gun shows and over the internet.

“I support the Manchin-Toomey, I’ve always done that,” Manchin told reporters, according to The Hill. “The Manchin-Toomey is the one. I think if you can’t get that one, then why try to do something just for basically voting for the sake of voting?”

While some Democrats want action on a universal background check bill that passed the House in March last year, the West Virginia moderate has previously said that bill goes too far because it would extend to private transactions, such as those between neighbors, hunting buddies, or even family. The Manchin-Toomey bill exempted those transactions.

“The best piece of legislation that we’ve ever had, that most people agreed on, was the Manchin-Toomey. We didn’t infringe on anyone’s rights privately,” Manchin said.

But if Manchin-Toomey was the bill “that most people agreed on,” that wouldn’t mean much — the bill failed in 2013, coming six votes short of the 60-vote threshold to overcome a filibuster at a time when a stronger Democratic majority held the Senate. Only two Republicans voted for it, Toomey and Sen. Susan Collins (R-Maine).

It is far more unlikely that 10 Republicans would cross the aisle to vote for any sort of gun control bill this year, especially before the midterm elections in November.

Joe Manchin says he would vote to codify Roe v. Wade, but opposes the bill Democrats want

Sen. Joe Manchin (D-W.Va.) on Wednesday reaffirmed his opposition to a radical Democratic abortion bill that is going nowhere fast in the United States Senate.

Democrats have scheduled a vote on the Women’s Health Protection Act later today, a bill that would codify the abortion rights established by Roe v. Wade and override state pro-life laws restricting abortion access or regulating abortions for health and safety. The bill needs 60 votes to overcome an expected filibuster by Republicans, though Democrats may struggle to find even 50 votes in favor.

Manchin, who claims to be a pro-life Democrat, told reporters he would not vote for the WHPA, arguing it was too broad.

“We’re going to be voting for a piece of legislation that I will not be voting for today,” Manchin said.

“But I would vote for a Roe v. Wade codification if it was today. I was hopeful for that, but I found out yesterday in caucus that that wasn’t going to be,” he added.

“To me, that would be the reasonable, rational thing to do. The bill we have today to vote on, Women’s Health Protection Act … make no mistake, it is not Roe v. Wade codification, it is an expansion. It wipes 500–500 state laws off the books. It expands abortion,” he said.

Democrats have demanded federal action to protect abortion rights in the wake of a leaked draft Supreme Court majority opinion that indicates the court will soon overturn the landmark Roe v. Wade abortion rights decision.

Senate Majority Leader Chuck Schumer (D-N.Y.) has insisted on a show vote for the WHPA even though everyone in the Senate understands that it will not pass. He has said that Republicans need to be put on the record opposing abortion rights, calling this vote “one of the most consequential we will take in decades.”

“All of us will have to answer for this vote for the rest of our time in public office,” Schumer said in a floor speech Wednesday morning. “Before the day is over, every member of this body will make a choice [to] stand with women to protect their freedoms or stand with MAGA Republicans to take our country into a dark and repressive future.”

A bipartisan bill that would more narrowly codify Roe while permitting states to regulate abortions for health and safety and enact conscience protections for Catholic hospitals has been introduced by Republican Sens. Susan Collins of Maine and Lisa Murkowski of Alaska. Although Manchin is likely to support that bill and it could even get support from 52 senators, Schumer has declined to give it a vote.

Manchin said the Senate should not overreach on an issue that is “extremely political” and could alienate voters.

“We should not be dividing this country further than we’re already divided,” he said. “And it’s really the politics of Congress that’s dividing the country. It’s not the people. They’re telling us what they want. And it’s just disappointing that we’re going to be voting on a piece of legislation which I will not vote for today. But I would vote for Roe v. Wade codification if it was today, I was hopeful for that. But I found out yesterday in caucus that wasn’t going to be.”

Democrats' plan to codify abortion through legislation is dead on arrival in Senate

Senate Majority Leader Chuck Schumer vowed Tuesday to bring legislation that legalizes abortion to a vote in the Senate. Unfortunately for pro-abortion lawmakers, the effort is already doomed to fail.

What are the details?

After a leaked opinion draft from Supreme Court Justice Samuel Alito showed the Supreme Court has voted to overturn abortion precedents, Democratic lawmakers began calling for abortion to be codified into federal law.

“It is our intention for the Senate to hold a vote on legislation to codify the right to an abortion in law,” Schumer said from the Senate floor.

However, the purpose of such a vote, Democratic Whip Senator Dick Durbin revealed, is actually more about political theatrics than legalizing abortion. “More than anything we want to make sure every senator is on the record in terms of their position on Roe and on the decision of the court,” Durbin admitted, Politico reported.

Still, to pass a law codifying abortion, Democrats would need 60 votes — or just 50 votes if the filibuster is abolished.

But unfortunately for Democrats, the moderate senators who have thus far refused to support abolishing the filibuster reiterated their positions on Tuesday.

What did those senators say?

Sen. Joe Manchin (D-W.Va.) said, “The filibuster is the only protection we have in democracy.” He did not comment specifically on the leaked opinion.

Meanwhile, Sen. Kyrsten Sinema (D-Ariz.) also signaled that she will not support abolishing the filibuster, implicitly referring to the procedure and saying it has protected women’s health.

“Protections in the Senate safeguarding against the erosion of women’s access to health care have been used half-a-dozen times in the past ten years, and are more important now than ever,” Sinema said in a statement.

And a spokeswoman for Republican Sen. Susan Collins (R-Maine), who recently introduced a bill to codify the Supreme Court’s abortion precedents, told reporters that Collins’ position on the filibuster has not changed in light of the leaked opinion draft.

“Senator Collins’ position on the filibuster is unchanged,” said Anne Clark, a spokeswoman for Collins.

With a 50-50 split Senate and moderate lawmakers unwilling to abolish the filibuster, Democrats’ attempt to save abortion will be dead on arrival.
