Swedish Parties Call for Change of Constitution to Guarantee Right to Abortions

Leftist prosecutors refuse to enforce abortion bans, setting up conflict with pro-life states

Dozens of locally elected prosecutors from all over the country, many from Democratic areas within red states, are refusing to enforce abortion restrictions that have now been legalized following the U.S. Supreme Court’s decision in Dobbs v. Jackson Women’s Health Organization.

After the court overturned its 1973 Roe v. Wade decision Friday — permitting pro-life state legislatures to enact abortion restrictions — 90 elected prosecutors collectively representing more than 91.5 million people from 31 states and territories and the District of Columbia declared their intention to ignore pro-life laws restricting abortion, calling them “a mockery of justice.”

“We stand together in our firm belief that prosecutors have a responsibility to refrain from using limited criminal legal system resources to criminalize personal medical decisions,” the prosecutors said in a joint statement organized by Fair and Just Prosecution, a left-leaning legal nonprofit.

“As such, we decline to use our offices’ resources to criminalize reproductive heath decisions and commit to exercise our well-settled discretion and refrain from prosecuting those who seek, provide, or support abortions,” the statement reads.

The actions of these pro-abortion attorneys will escalate a growing conflict between liberal prosecutors who support abortion rights and pro-life state attorneys general and legislatures who, in accordance with the will of voters, enact restrictions on abortion.

Many of the prosecutors who signed on to the joint statement are from 12 states where abortion is now banned or likely to be banned, including Alabama, Georgia, Missouri, Tennessee, Texas, Utah, and others. They argue that prosecutorial discretion permits them to prioritize other crimes instead of pursuing cases against abortion providers.

Pro-life advocates harshly criticized their position. James Bopp Jr., the general counsel of the National Right to Life Committee, said the prosecutors’ statement was “anti-democratic” in a statement to CNN. His organization has published model legislation for pro-life lawmakers that would enable state attorneys general to take up abortion cases when local prosecutors refuse to do so.

“They were not elected to decide what the law was,” Bopp told CNN. “If they don’t want to enforce these laws, then we’ll have somebody else do it.”

Some state attorneys general already possess the power to override local prosecutors. Alabama and Arizona are two states, among others, where the attorney general holds the power to supersede local prosecutors for any reason, according to Emory Law Journal. They each have elected Republican attorneys general and have laws banning abortion that may take effect after the Supreme Court’s decision.

Florida, Michigan, and several other states give broad powers to state officials to override local prosecutors when they deem it to be in the public interest, Politico reported.

Republicans have criticized the abuse of prosecutorial discretion by Democratic prosecutors.

“We have no doubt they are sincere in their pledge to not do their jobs,” a spokeswoman for Georgia attorney general Chris Carr told the Center Square after local district attorneys said they would not enforce the state’s heartbeat bill.

“It’s a dereliction of duty for district attorneys and solicitors to pre-emptively pick and choose which laws they will enforce,” Carr spokeswoman Kara Richardson said. “It undermines the rule of law and erodes our system of self-governance.”

Florida judge strikes down 15-week abortion ban, DeSantis vows appeal

Florida Republican Gov. Ron DeSantis will appeal after a state court ruled the 15-week abortion ban he signed in April violates Florida’s constitution.

In a Thursday decision, Leon County Circuit Court Judge John C. Cooper blocked the abortion ban from taking effect on Friday. He ruled that the law violates “the privacy provision of the Florida Constitution.”

The Florida law prohibits abortions after 15 weeks of pregnancy except for medical emergencies where the life of the mother is endangered or the unborn baby has a fatal defect. Violators could face up to five years in prison, and medical professionals who conduct abortions risk losing their licenses and paying fines of $10,000 per violation.

Left-wing groups including the American Civil Liberties Union, Planned Parenthood Federation of America, and the Center for Reproductive Rights filed a lawsuit on June 1 seeking an injunction against the Florida law.

They argued that the Florida law is “blatantly unconstitutional” under the state constitution, which reads in part: “Right of privacy: Every natural person has the right to be let alone and free from governmental intrusion into the person’s private life.”

“In 1980, Florida voters amended the state constitution to provide broad protections for individual privacy rights — including abortion. And in 2012, voters overwhelmingly rejected Amendment 6, which would have taken those protections away,” the ACLU of Florida said in a statement.

“While the U.S. Supreme Court’s shameful ruling in Dobbs v. Jackson Women’s Health Organization took away the federal constitutional right to abortion, the Florida Constitution provides broad, independent protections for abortion. These protections, which have been repeatedly affirmed by Florida voters and decades of legal precedents, continue to protect Floridians’ fundamental right to abortion,” the group argued.

ACLU lawyers and representatives from Florida abortion clinics celebrated the court’s decision.

“We’re glad the court recognized Florida’s abortion ban is a cruel attack on people’s health, futures, and state constitutional rights,” ACLU attorney Whitney White said. “Florida’s 15-week ban would force people to carry pregnancies against their will, risking their health and depriving them of the right to make deeply personal decisions about the course of their own lives. This ban defies the will of the people and rights that Floridians have relied on for decades.”

DeSantis’ office rejected the court’s argument in a statement announcing it would appeal the decision.

“While we are disappointed with today’s ruling, we know that the pro-life HB 5 will ultimately withstand all legal challenges. The Florida Supreme Court previously misinterpreted Florida’s right to privacy as including a right to an abortion. We reject this interpretation because the Florida Constitution does not include–and has never included–a right to kill an innocent unborn child. We will appeal today’s ruling and ask the Florida Supreme Court to reverse its existing precedent regarding Florida’s right to privacy. The struggle for life is not over.”

Bill Maher explains why Dems keep LOSING and how they could use lessons from Johnny Depp

On “The Rubin Report” this week, BlazeTV host Dave Rubin reacted to a recent episode of “Real Time with Bill Maher” in which the liberal talk show host tore into Democrats for fumbling the abortion issue by making it about “woke-y” terms like “birthing people” and “people who menstruate” instead of women’s rights.

“And then there’s abortion, a difficult issue for the Democrats to lose on — but they’re trying,” Maher said to guest panelist Andrew Sullivan.

“For decades, liberals have said ‘if only men could get pregnant this wouldn’t even be an issue’ and ‘abortion rights are women’s rights.’ Well, that’s wrong now,” he continued. “When the wokey end of the progressive spectrum talks about abortion now they shy away from that word ‘women’ and prefer terms like ‘birthing people’ or ‘people who menstruate’ because somewhere there’s a trans man who’s pregnant. … Oh, Democrats, let’s take the first f***ing word a human animal understands, mama, and replace it with something best understood by four Trotskyites at Berkeley.”

Maher added, “The wavering voter is saying to her lawyer, the Democratic Party, ‘Hey, I’m so happy for you that you have so many other clients, and that you care so much about their problems and all the pro bono work you do, but you’re supposed to be my lawyer.'”

Earlier in the episode, Maher referenced Johnny Depp’s defamation trial to illustrate the need for “a good representative in court” and compare that to the voters’ need for good representation in Congress — something the Democratic Party is completely failing to provide.

“In the American political system, the people are represented by two separate but equally stupid groups: The Republicans, who normalize constitutional crimes, and the Democrats, who pit identity groups against each other. These are their stories,” Maher said, playing on the opening line to the show “Law & Order.”
