Governor Murphy’s hubris on display as New Jersey sees epic amounts of high profile crime

September 27, 2023 by John Petrolino Leave a Comment

Covering crime and violence in the Garden State is usually like shooting fish in a barrel. That being said, it’s all too hard to ignore the influx of violent criminal activity that’s being reported on through the local Patch recently. All of these cases can be chalked up to “just another crime in New Jersey,” however it’s still important to reflect on them in the right context. Democratic Governor Phil Murphy has no love for law-abiding gun owners, and has done everything he possibly could to throw roadblocks up in front of those who wish to exercise their civil liberties. How’s Murphy’s policies helping out the problem of criminal elements? Spoiler – they’re not.

A couple of weeks ago, there were big pushes in New Jersey seeking leeds on a two-year-old rape case. The rape occurred in a New Jersey county park. That county happens to be Monmouth, where Murphy himself resides in the nearbt township of Middletown.

The investigation determined that the female victim was running in the area, training for a marathon, when she noticed a male stretching nearby.
…

It was further revealed that the man physically attacked the victim, causing her to fall to the ground, and brandished a box cutter-style knife, which he used to cause minor injuries to her arms.

The man then allegedly exposed himself and sexually assaulted the woman. He fled in an unknown direction.

Considering that Governor Phil Murphy signed a law in December 2022 that outlawed the carry of a firearm in any and all town, county, and state parks, he’s pretty much committed to seeing more attacks like this occur. The law did suffer two TROs and a preliminary injunction, stopping the enforcement of the law, however, a stay at the Third Circuit Court of Appeals allowed for the law affecting parks to stand for now. It’s not a foregone conclusion that the rape victim would not have been attacked and or raped had she been armed, she did not have that option then, and she does not now – thanks to Governor Phil Murphy and New Jersey’s corrupt legislature.

In quick succession the past two days there’s been a flurry of activity that proliferates under Murphy’s mismanagement. The fact is that with the carry laws in the state in a constant status of flux, as well as there being no clear guidance from the N.J. State Police and Attorney General Platkin’s office, many don’t know about their options when it comes to carrying.

Here are some real gems that hit my inbox:

Another Bear Spray Attack? BurlCo Restaurant Robbery Probed: Police | Moorestown, NJ Patch

A lone male suspect, wearing a gas mask, entered Mikado Japanese Sushi & Steak House (793 E Route 70) at 10:21 p.m. — after closing time — officials said. The individual sprayed a chemical irritant at an employee, bound her hands and feet, and duct taped her mouth, according to the Evesham Police Department.

The suspect then stole an undisclosed amount of money from the cash register and fled in an unknown direction, authorities said. The victim remained constrained until a coworker found her. She was treated at Virtua Hospital and released.

Evesham police aren’t sure whether the suspect used pepper spray or bear spray. A similar attack occurred days earlier in Medford.

Man Accused Of Rape, Strangulation Of Woman In Franklin Township | Hillsborough, NJ Patch

McDonald, Somerset County Prosecutor’s Office Chief of County Detectives Francisco Roman Jr., and Franklin Township Public Safety Director Quovella M. Maeweather.

The woman said she was sexually assaulted and physically assaulted by Espinal-Brito in the early morning hours of Sept. 11.

Mateo Espinal-Brito was placed under arrest at the Franklin Township Police Department without incident following an investigation by the Somerset County Prosecutor’s Office Sex Crimes/Child Abuse Unit and detectives from the Franklin Township Police Department.

Stabbing Suspect Captured At Jersey Shore: Police | Ocean City, NJ Patch

Police had been searching for Terrance Dore, 43, since the crime on Sept. 10. He was found in Atlantic City on Sept. 24 at about 4 p.m. where local police took him into custody without any incident, police said.

On Sept. 10 just before 9 p.m., police responded to a residence at 100 West Poplar Ave. for reports of a stabbing victim.

Police and members of the fire department found the woman who had been stabbed about two blocks away with multiple stab wounds on her upper body, police said.

Attempted-Murder Convict Escapes State Custody In NJ: Police | Moorestown, NJ Patch

A man convicted of attempted murder escaped state custody, according to Mount Laurel police said Tuesday.

Edward Berbon had been in state custody since 2004. Assigned to a halfway house, Berbon was on a work detail in Mount Laurel during his escape, authorities said.

If that’s not enough of a bombardment of violent criminal activity coming from the local Patch, I don’t know what is. In all of these situations, being an armed victim or potential victim would tip the scales and equalize force. The thought of being armed never comes out of the progressive corners as a viable option for self-defense. Quite actually, not advocating for the arming of law-abiding citizens is anti-women’s rights, in addition to a whole host of other things.

Murphy does not care about the rape victims. This brings us to one last case where you can decide how you feel about it.

3 Men Accused In Marlboro Rape To Plead Guilty To Criminal Restraint | Freehold, NJ Patch

Three men charged with sexual assault of a woman restrained in a bedroom in one man’s Marlboro home will each plead guilty to lesser charges of criminal restraint, the Monmouth County Prosecutor’s Office has confirmed.

Andrew J. Gallucci of Marlboro, Richard S. Gathy of Manalapan, and Ronald W. Hondo of Monroe Township have each pleaded guilty to third-degree criminal restraint, county prosecutor’s office spokesman Mark Spivey said Tuesday.

…

“This was a disturbingly coordinated and predatory attack,” then-Acting Prosecutor Lori Linskey said. “We commend the courage of the victim in coming forward to report what happened to her, and we look forward to bringing those responsible to justice.”

The then-Acting Prosecutor, Lori Linskey, also Monmouth County, is emblematic of the problems we’re facing, in particular victims of sexual assaults and rape. Linskey goes on to talk about how brave and responsible it was for the victim to come forward, but what, the perpetrators were allowed to plead to a lesser crime? Doesn’t this undercut the disturbing criminal attack that was directed at a woman, completely diminishing her own harrowing experience? We don’t hear Linskey advocating for women to get trained and armed, do we? Where’s the justice Linskey is advocating for?

The narrative in New Jersey is just disgusting. Holding up the rhetoric from the progressive talking heads and comparing it to these gross acts is just disturbing. Clearly the policies not only don’t help the situation in New Jersey, they enable it. The Democratic party in New Jersey needs to come to terms with the issue of arms and them being a viable option for people to not be victims of crime. Governor Murphy, he’s guarded 24-7 by armed guards who he has alleged in the past are guarding him because they want to, can go pound sand. It’s easy to wipe away everyone else’s civil liberties when you yourself live in an ivory tower. Reform is something we do need in the state, but not in the twisted way Murphy and his misguided ilk want.

Garden State’s anti-gun Menendez should reap what he sows

September 26, 2023 by John Petrolino Leave a Comment

United States Senator Robert “Bob” Menendez, D- N.J., was recently indicted for federal corruption charges, again. The perennially disgraced Senator is not rounding the corner of controversy for the first time in his sordid career. In 2015 the Senator was indicted on corruption charges – surprise surprise – and in 2017 a hung jury was not able to reach a conclusion concerning his guilt. Menendez finding himself embroiled in another bout of corruption, I say he should reap what he sows. “Throw’em into prison for five years,” is what Menendez was quoted of saying about permit to carry holders who bring a firearm into the Garden State back in 2017, and he deserves the same treatment. And then some.

Menendez’s 2015 corruption indictment revolved around an alleged relationship he had with one Salomon Melgen. According to the DOJ, the charges were based on bribery allegations, whereas “Menendez allegedly accepted gifts from Melgen in exchange for using the power of his Senate office to benefit Melgen’s financial and personal interests.”

Specifically, the indictment alleges that, among other gifts, Menendez accepted flights on Melgen’s private jet, a first-class commercial flight and a flight on a chartered jet; numerous vacations at Melgen’s Caribbean villa in the Dominican Republic and at a hotel room in Paris; and $40,000 in contributions to his legal defense fund and over $750,000 in campaign contributions.  Menendez never disclosed any of the reportable gifts that he received from Melgen on his financial disclosure forms.

According to allegations in the indictment, during this same time period, Menendez allegedly engaged in three efforts to use his Senate office and staff to advocate on behalf of Melgen’s personal and financial interests.

Other allegations also surfaced, as quoted in a court opinion concerning a motion to dismiss, stating that there was “an investigation into allegations that Senator Menendez and Dr. Melgen had had sexual relationships with underage prostitutes at Dr. Melgen’s home in the Dominican Republic.”

In the course of the search for evidence related to the health care fraud investigation, agents discovered several items that appeared to be relevant to the prostitution and PIN investigations

…

On January 30-31, 2013, Agent Sheehy and federal prosecutors prepared an affidavit for a warrant to search the segregated PIN Inventory items for evidence “related to a violation” of several public corruption and sexual offense statutes. Mot. Dismiss 15 at 12. The affidavit described the black bound notebook as a “ledger of prostitution activities” that included Senator Menendez’s name on several pages, above “a list of several women, along with, again, these women’s phone numbers, their nationalities, and their prices.”

The case basically went flat when there was a hung jury and no retrial was scheduled. Unlike what happened to some other Menendezes, talk about preferential treatment. Menendez was seemingly off the hook until the most recent corruption charges were levied against him. The indictment was filed last friday. The document specifically states that Menendez is alleged to have made deals that would have benefited the government of Egypt and an Egyptian-American businessman. A 2022 search warrant uncovered plenty of potential “fruits” from his relationships.

In or about June 2022, federal agents executed search warrants on the New Jersey home and the safe deposit box of ROBERT MENENDEZ and NADINE MENENDEZ, a/k/a “Nadine Arslanian,” the defendants. In conducting these court-authorized searches, agents found certain of the fruits of MENENDEZ’s and NADINE MENENDEZ’s corrupt bribery agreement with WAEL HANA, a/k/a “Will Hana,” JOSE URIBE, and FRED DAIBES, the defendants, including cash, gold, the luxury vehicle, and home furnishings. Over $480,000 in cash—much of it stuffed into envelopes and hidden in clothing, closets, and a safe—was discovered in the home, along with over $70,000 in NADINE MENENDEZ’s safe deposit box. Some of the envelopes contained the fingerprints and/or DNA of DAIBES or his driver. Other of the envelopes were found inside jackets bearing MENENDEZ’s name and hanging in his closet, as depicted below.

As reported by my colleague Spencer Brown, over at Townhall, Menendez addressed the cash in a press conference, “In Monday’s press conference, Menendez seemed to be trying out an explanation for the nearly half-million dollars in cash found stashed around his home when he said he frequently withdraws thousands of dollars due to the ‘history of my family facing confiscation in Cuba.’” Brown further observed:

That apparent excuse, however, does not explain the gold bars, luxury vehicle, or other alleged “gifts” Menendez received for his participation in the bribery scheme described in the indictment.

It also, notably, does not explain how — as the indictment stated — some of the envelopes had “the fingerprints and/or DNA of Daibes,” another defendant in the federal corruption case Menendez allegedly used his “power and influence as a senator to protect and enrich.”

So an anti-gun New Jersey politician has a few allegations against him and some skeletons in his closets. What a revelation. All people are innocent until proven guilty, are they not? Well, I hope nothing for the best for Menendez – or he should at least be treated the same way he wants gun owners to be treated.

In 2017 it was reported that Menendez, fresh off his hung jury, perhaps emboldened as some sort of a nuevo teflon don, made statements indicating permit to carry holders that come into New Jersey with their firearms should just be locked up for five years, a provision of the Graves Act. That’s a tough bar to reach for, and yes New Jersey’s law is that draconian, but what about people who inadvertently come into New Jersey not really knowing the law, without criminal intent? We’re not sure what the real intent of all that gold and cash is in Menendez’s belongings and safe deposit boxes, but maybe he should too be spanked with the maximum penalty for these corruption charges regardless?

“Throw’em into prison for five years” is what New Jersey Democratic Sen. Bob Menendez wants for any out-of-state concealed carry permit holder who enter his state with a firearm.

“People violate our law — we are a state that has decided that we are against concealed carry weapons. We have stronger gun laws. We believe we have made the states safer as that,” Menendez told The Daily Caller Thursday. “They violate our laws, then whatever is the law, and they are found guilty of it, they should pay the consequence.”

When pressed about travelers with concealed carry permits who may be detoured into his state by accident, he replied: “They know what our state’s law is. They should know what our state law is if they want to carry a concealed weapon. I don’t think that they just simply get detoured and they should think in advance when they are traveling.”

There you have it folks. That’s what Menendez thinks about people breaking laws where there are no victims. Firearm possession should not be a crime in of itself, we all know this. Firearm possession is a civil right, period.

Let’s all toss out the allegations of leaving the country to solicit for underaged prostitution – no potential victims there. Let’s all ignore the leger listing Menendez as a “client.” Let’s all ignore the corruption charges, the large sums of cash – with the DNA from his ‘donors’ on it, the gold bars, and everything that Menendez has alleged to have committed. Let’s turn a blind eye to everything he’s potentially done…

Or not. Senator Bob Menendez, you continue to be a disgrace to the Garden State. So much so that even Governor Phil Murphy, D-NJ, and a whole pile of pinkos have turned on you. What else you have actually done – besides all that – to upset the political machine, whatever it all is, you’re going to hopefully get what you deserve. You’ve clearly transgressed so bad that the swamp doesn’t want you anymore. That’s a whole other story. The story of what’s really going on?

This can be best summed up by and should be treated equivalent to the Senator’s character, or lack thereof. Menendez does not respect civil liberties and in turn he himself deserves none. Of the allegations, the slimy senator had to say, “Those behind this campaign simply cannot accept that a first generation Latin American from humble beginnings could rise to be a U.S. senator.” To quote the daddy of the great Robert “Bobby” Boucher Jr., I invite Menendez to resign and simply say, “Ciao, Roberto.”

HT to my good friend Teddy for reminding me of the disgraced senator’s 2017 remarks.

Chuck Schumer’s Rather Interesting Reaction to the Bob Menendez Indictment Is Analyzed

September 25, 2023 by Sister Toldjah Leave a Comment

Though it probably wasn’t surprising to most of them, news of Sen. Bob Menendez’s (D-N.J.) indictment caused ripples among Democrats in the Garden State and on Capitol Hill Friday, with some soon determining that the seriousness of the bribery charges against Menendez and his wife, Nadine, along with the evidence presented warranted a call for his resignation.

Among them were New Jersey Gov. Phil Murphy, a number of Democratic members on the House side of the state legislature, and two of Menendez’s Democratic colleagues in the U.S. Senate: John Fetterman (Pa.) and Sherrod Brown (Ohio).

One powerful Democrat whose reaction to the Menendez indictment has been far more muted is Sen. Majority Leader Chuck Schumer (D-N.Y.), who on Friday issued a short statement of praise for Menendez while noting that he believes Menendez deserves “due process and a fair trial”:

“Bob Menendez has been a dedicated public servant and is always fighting hard for the people of New Jersey. He has a right to due process and a fair trial.

“Senator Menendez has rightly decided to step down temporarily from his position as Chairman of the Foreign Relations Committee until the matter has been resolved.”

One would think this being Menendez’s second indictment in ten years on allegations of bribery would warrant more of a strongly worded response from Schumer that wasn’t quite so accommodating of his longtime Senate friend, especially considering Schumer’s previous position on the “alleged pattern of criminal activity” of former President Donald Trump:

The fourth indictment of Donald Trump, just like the three which came before it, portrays a repeated pattern of criminal activity by the former president.

— Chuck Schumer (@SenSchumer) August 15, 2023

So having multiple indictments is supposed to be a sign of guilt, right? Or not – when it involves Democrats, I guess:

pic.twitter.com/aPwMtFbDOL

— Ken Klippenstein (@kenklippenstein) September 25, 2023

As a reminder, here’s how Menendez’s 2017 trial went down:

The last time Menendez was indicted in 2015, he was charged with receiving gifts and $660,000 in campaign contributions from a Florida eye doctor, Salomon Melgen, that helped him get reelected to the Senate in 2012. Menendez was accused of using his office to promote Melgen’s business and personal interests with officials of President Barack Obama’s administration.

Menendez argued the money and gifts such as luxury travel stemmed from their friendship rather than a criminal relationship.  In 2017, Menendez’ corruption case ended in a mistrial after the jury could not reach a verdict and the government decided not to retry him.

Some legal experts have suggested that the case against Menendez this time around is much stronger than the 2015 case, and have predicted that a conviction is far more likely, though the embattled Senator is likely to use a defense in this trial similar to the one he used in his last one: The friendship defense.

In any event, while Schumer is right in one respect – people have the right to due process and a fair trial – for him that rule apparently only applies depending on the party affiliation of the person who has been accused.  Not that this is a surprise, of course, but it’s worth noting for the record all the same.

John Fetterman Calls on Bob Menendez to Resign, Irony of Which Is Lost on Fetterman

September 25, 2023 by Ward Clark Leave a Comment

In one of modern politics’ great ironies, Pennsylvania Senator John Fetterman has been the only Democrat in the Senate to call for the resignation of New Jersey’s Senator Bob Menendez.

Sen. John Fetterman, D-Pa., has called for Sen. Bob Menendez of New Jersey to resign in the wake of bombshell bribery allegations against him, but so far their Democratic colleagues are being more guarded.

In interviews on Sunday news programs, three Democratic senators were highly critical of Menendez, who was recently indicted on sweeping corruption charges, but did not call for him to vacate his seat in the Senate, where Democrats have a slim majority.

Sen. Chris Murphy, D-Conn., who’s on the Foreign Relations Committee, which Menendez chaired until Friday, called the allegations “devastating.”

My RedState colleagues have been covering this story as it unfolds; read these for the complete picture:

As of this writing, however, Fetterman is the first sitting senator to call on Senator Menendez to surrender his Senate seat.

Fetterman became the first Democratic senator to call for Menendez to resign Saturday. “He’s entitled to the presumption of innocence under our system, but he is not entitled to continue to wield influence over national policy, especially given the serious and specific nature of the allegations,” Fetterman said in a statement.

Menendez has denied wrongdoing, and he said in a statement Friday night, “I’m not going anywhere.”

Of course, Senator Menendez is innocent until proven guilty; he is entitled to the same constitutional rights and the same protections under the law as any citizen. But on the execution of a search warrant, federal investigators found almost half a million dollars in cash as well as gold bars, and there are records of mysterious mortgage payments by third parties, among other things.

That’s a lot of smoke for there not to be a fire there someplace.

It sure appears that Senator Menendez intends to brazen his way out of this. But his legal protections don’t preclude increasing calls for him to resign, and it seems unlikely in the extreme that Senator Fetterman will be the last Democrat politician to call for him to step down. Unless there is just some staggeringly good defense that Senator Menendez’s attorneys are going to unleash, his political career has taken a shot to the hull and is taking on water fast.

Senators aside, New Jersey’s Governor and some other New Jersey (and therefore Democrat) politicians are calling for Menendez to step away:

Numerous Democrats in Menendez’s home state, meanwhile, including Gov. Phil Murphy, have called for him to step down. Rep. Andy Kim, D-N.J., has also called on him to resign, and he said Saturday he plans to challenge Menendez for his seat.

Expect these calls to grow louder and more insistent as the case proceeds.

But what about John Fetterman?

Senator Fetterman is arguably unfit to serve in the Senate himself. Forget his presiding over the Senate dressed in a manner that a janitor would find slovenly and unacceptable; forget his bizarre response to the House impeachment inquiry. He has serious health issues, both physical and mental, that should have precluded his being elected, much less holding his Senate seat throughout all of his various issues.

The fact that one senator who is arguably unfit to serve due to mental and physical health issues calls for the resignation of another senator who is arguably unfit to serve due to credible allegations of corruption? If that’s not the great irony of the week, it will do until a better one comes along.

Bob Menendez Isn’t Backing Down in the Face of Bribery Charges: Indicates He Will Seek Re-Election

September 25, 2023 by Jeff Charles Leave a Comment

Despite the serious indictments against him, Sen. Bob Menendez (D-NJ) seems confident that he will be exonerated. During a recent press conference, he all but formally confirmed that he will be seeking re-election even though he is being charged with bribery offenses.

The indictment, which was unsealed last week, accuses the senator and his wife, Nadine, of accepting bribes from three businessmen between 2018 and 2022. On Monday, he denied the allegations and claimed he would be vindicated.

Sen. Bob Menendez, D-N.J., insisted at a press conference Monday he will be exonerated on a new federal corruption indictment.

Menedez detailed his decades-long record in Congress and insisted hundreds of thousands of dollars in cash the FBI found at his home was withdrawn from his personal savings account.

“The allegations leveled against me are just that, allegations,” Menendez said. “For anyone who has known me throughout my 50 years of public service, they know I have always fought for what is right. My advocacy has always been grounded. And what I learned from growing up as the son of Cuban refugees, especially my mom, my hero, Evangelina Menendez. Everything I accomplished, I worked for despite the nay sayers and everyone who has underestimated me.”

“I firmly believe that when all the facts are presented, not only will I be exonerated, but I still will be New Jersey’s senior senator,” he added, falling short of formally announcing re-election. “The court of public opinion is no substitute for our revered justice system. We cannot set aside the presumption of innocence for political expediency when the harm is irrevocable.”

Federal prosecutors allege that Menendez received hundreds of thousands of dollars in bribes, including cash, gold, a Mercedes Benz, and other valuable items. In exchange, he allegedly used his position in the Senate to protect the businessmen and benefit the government of Egypt. The lawmaker is alleged to have improperly pressured an official in the Department of Agriculture to shield a business monopoly granted to one of the businessmen, who is Egyptian. It is also believed that Menendez disrupted a criminal investigation launched by the Office of the New Jersey Attorney General.

Sen. Menendez has hired attorney Abbe Lowell to represent him. Lowell has experience litigating high-profile cases and is also representing Hunter Biden in his gun charges case.

Legal experts seem to have varying opinions on Menendez’s chances of being exonerated. Some point out that the evidence in his case is compelling, which could lead to a conviction if he goes to trial. Others have pointed out that the senator has faced these types of allegations before without seeing accountability.

Another noteworthy element in this equation is that Menendez could face impeachment hearings since he is refusing to resign. This could potentially influence the upcoming election, where a prolonged legal battle might help a Democratic primary challenger unseat him.

Whether Menendez will face jail time remains to be seen as the case is likely fraught with complexities. Still, this will definitely be a case that will be closely watched as more details emerge.
