No charges for gas station clerk who blasted suspected armed robber: ‘I’m not happy I had to shoot him, but I’m not stressing’

An Arizona clerk proved unwilling to end up buried while working the graveyard shift this week at a gas station in Avondale.

Brian (who has also been referred to as Ryan in some reports) was working at the Chevron gas station Wednesday morning on 107th Avenue and Indian School Road. Around 5:15 a.m., a potential robber barged in, waving a handgun and jabbering about money.

While the robber was unintelligible on account of his face covering, Brian told KSAZ-TV that “he didn’t need to say anything.”

“The moment he pointed the gun at me, it was pretty obvious what he was there for,” the clerk told the station.

When the suspect took aim at a customer, Brian reckoned it was pretty obvious what he in turn had to do.

“I had the opening to pull my gun and shoot,” the clerk told KPNX. “That’s pretty much the whole thing.”

Brian elsewhere underscored that he has long trained with a gun.

According to police, the “suspect became distracted by another person in the store and the store employee took the opportunity to pull out and use his own firearm, shooting and injuring the suspect.”

“I’m not happy I had to shoot him, but I’m not stressing. The moment he pulled the gun on me he set the situation and I just followed it. He made the situation what it was,” added Brian.

An employee told the Arizona Republic that “everybody is fine,” except, of course, for the suspect who was taken to a hospital in critical condition.

Brian will reportedly not be charged for restoring order at dawn.

Despite this outcome, Joshua Black, an employment attorney, suggested to AZ Family, “My advice would be to someone working at a gas station would be, do not carry a gun. Do not bring a gun. There is nothing at that job that is worth risking your life.”

There is no shortage of robbery survivors who might feel compelled to discount Black’s recommendation.

A clerk at Blackhawks Tobacco & Vape in Rock Island, Illinois, was reportedly confronted by three robbery suspects Tuesday night, one of whom threatened him and his customers with a gun.

When one of the robbers allegedly took aim at a customer, the clerk readied his firearm and “emptied the magazine” into the suspect. No innocents perished in the incident.

TheBlaze reported in July that a female clerk in Texas was reportedly robbed and attacked by a knife-wielding suspect. Owing to the clerk’s quick thinking, she survived survived with only minor injuries, having shot the robber, who was later taken to an area hospital with serious injuries.

Extra to those Black’s recommendation may not resonate with, there are also unarmed robbery victims who might have otherwise benefitted from firepower like Brian’s.

For instance, a 67-year-old Exxon gas station clerk working the graveyard shift in northeast Philadelphia was fatally gunned down earlier this week during a similar robbery.

A Florida man fatally shot an intruder early Tuesday morning in the Lynn Haven home he shares with his wife and child, Bay County Sheriff’s deputies told WMBB-TV.

What are the details?

Around 6 a.m. the wife told her husband about the intruder inside their home in the 1400 block of North Bay Drive, the station said.

The sheriff’s office said the intruder was a male.

With that, the husband grabbed a gun and confronted the intruder, WMBB added.

Deputies told the station that amid an altercation between the husband and the intruder, the husband fatally shot the man.

The husband and wife and their child are all safe, deputies noted the WMBB.

The sheriff’s office added that they are investigating the shooting — but officials told WMBB in a separate story that the homeowner acted in self-defense, and no charges have been filed in the case.

A WMBB reporter said in a video about the incident that the husband reportedly shot the intruder twice.

In addition, the sheriff’s office added that it doesn’t appear that any other person was involved in the incident, and there is no danger to other neighborhood residents.

Who was the alleged intruder?

The alleged intruder has been identified as 23-year-old Aaron Mravic-Lollie, WMBB noted.

Investigators said the homeowner did not know Mravic-Lollie, who was pronounced dead at the scene, the station added.

How are folks reacting?

Commenters sounded off underneath the Facebook post from the sheriff’s office about the incident and seemed decidedly relieved and pleased that the homeowner exercised his Second Amendment rights. The following are but a few takes:

  • “PSA — some of us understand the Castle laws and how to castle up,” one commenter wrote. “For the crooks … make better choices. If you don’t, chances are you are not going to get the outcome you had hoped for.”
  • “Another good 2nd Amendment story!” another commenter said.
  • “The libturd Dumocrats will try to have this homeowner charged, but thankfully that won’t happen because we live in FLORIDA where common sense prevails and libturdism doesn’t prevail!!” another commenter declared.
  • “It doesn’t sound like the suspicious stranger will be back for another surprise visit,” another commenter stated.

Mother of fatally shot restaurant robber says customer who fired multiple rounds ‘abused’ her son: ‘Why didn’t you stop? … He was dead already … That hurts.’

The mother of a Houston restaurant robber who was fatally shot by a customer earlier this month said the customer who pulled the trigger multiple times “abused” her son in that moment, KRIV-TV reported.

“I don’t hate him. I can’t hate him,” Corine Goodman told the station in reference to the unnamed customer in a recent interview. “But I want to know why didn’t you stop? If you had to kill him, I can deal with that. I can come to grips with that. He did something wrong. I understand that. But for him to be shot four times in the back leaving, and when he falls down, he shoots him four more times? You abused him. He was dead already. And that hurt. That hurts.”

What’s the background?

Houston police told KHOU-TV in the station’s original story that an armed man in a mask entered Ranchito Taqueria on South Gessner near Bellaire Boulevard just before 11:30 p.m. Jan. 5 and demanded money and wallets from customers.

KHOU said in its broadcast that it froze the surveillance video before shots were fired but that the full video shows the robber being shot multiple times. KPRC-TV in its video report said nine shots were fired.

Customer who shot robber returned stolen money

Police told KPRC that the customer who shot the robber retrieved the stolen money from the robber’s pocket and returned the money to other patrons. In fact, KPRC said the customer could be heard on surveillance video saying, “Come get your money.”

KPRC added that video showed the customer discovering the robber’s gun was fake and throwing it against a wall in anger. Investigators told KHOU the robber’s gun was a plastic pistol.

Finally, the customer walked to the door, dumped a beverage on the robber lying on the floor, and walked out, KPRC said.

Those inside the restaurant departed before police arrived, KHOU said, adding that there were no reported injuries among customers or restaurant staff.

Houston homicide investigators later questioned the restaurant customer who fatally shot the robber. While the customer wasn’t arrested, charged, or named, a grand jury will review the case to determine whether charges against him are warranted.

What do we know about the robber?

The robber in this case has been identified as 30-year-old Eric Eugene Washington, KHOU said, adding that court records indicate this wasn’t his first robbery.

More from the station:

In 2013, he and others were charged with capital murder after a man was killed during an armed robbery, according to prosecutors. The charge was later changed to aggravated robbery with a deadly weapon and Washington was convicted and sentenced to 15 years in prison.

It’s unclear exactly when he was released, but the most recent time he was arrested was Dec. 16 when authorities said he pushed his girlfriend to the ground and scratched her. Washington was charged with misdemeanor family violence and was released on a personal recognizance bond.

“What he did, I don’t condone. He knew better. He never said anything that made me think he would go this route,” Goodman added to KRIV in regard to her son robbing restaurant customers. “He started working. He was striving because he said, ‘Mom, when you send someone to penitentiary, it breaks you.'”

In fact, Goodman added to the station that hours before the robbery, her son promised her that he’d do better: “Thursday morning was the last time he called me. He said, ‘Mom, son to mother, I’m trying to be the best person I can be.'”

She also told KRIV that Washington welcomed a newborn son four months ago — and that while she knew he was struggling financially, Goodman never realized her son was that desperate for help.

“He’s not the monster that people picture him to be,” Goodman added to the station.

The customer’s lawyer speaks

Criminal defense attorney Juan Guerra Jr. is representing the customer who fatally shot Washington, and Guerra released a statement Monday, according to KRIV:

“My Client who wishes to remain anonymous was dining with a friend at El Ranchito Taqueria, and as it has been seen on video, a robbery suspect entered the restaurant, pointed a weapon at my client and the other customers demanding money. In fear of his life and his friend’s life, my client acted to protect everyone in the restaurant. In Texas, a shooting is justified in self-defense, defense of others, and in defense of property. The customer has met with the Harris County District Attorney’s Office and Investigators with HPD homicide. He fully intends to continue cooperating with the ongoing investigation. When the investigation is complete, this case will be presented to a Grand Jury. We are confident that a Grand Jury will conclude that the shooting was justified under Texas Law. This event has been very traumatic; taking a human life is something he does not take lightly and will burden him for the rest of his life. For that reason, he wishes to remain anonymous. Due to the overwhelming coverage, we ask the media and the public to respect his privacy.”
